Near-Term Health Reform Changes for States: The Web Portal

In March of 2010 the President signed into law substantial health reform measures intended to reduce the number of uninsured citizens, increase access to services and provide higher quality delivery of care. While the majority of these reforms and policies will not be implemented until 2014, there are some forthcoming reforms that the states should take into account. One of them being, the Department of Health and Human Services (HHS) request for guidance on building a web portal.

HHS released a copy of its interim final rule (IFR) on May 5, 2010 for the insurance web portal requirements. The IFR, with the comment period ending June 4, 2010, addresses the near-term health reform measures aimed at reducing barriers to health insurance and making marketplace information more readily available.

But you may be asking yourself, how is all of the health care marketplace data going to be disseminated to the public if not all of the state health insurance exchanges are going to be ready prior to 2014? In the interim, the Administration has been working feverishly to meet the deadlines set forth by the Patient Protections and Affordable Care Act (PPACA) and has been tasked with establishing an internet portal to help individuals and small businesses identify insurance options in their state. Section 1103 of the PPACA provides that "Not later than July 1, 2010, the Secretary, in consultation with the States, shall establish a mechanism, including an internet website, through which a resident of any State may identify affordable health insurance coverage options in that State." Because of the short time frame between passage of the PPACA and the requirement that the portal be available on July 1, 2010, the portal will launch in phases.

The first phase of the portal will provide succinct information on the available coverage options, by state and zip code, in the private market and public programs. The portal will help citizens determine if they are eligible for programs such as state high risk pools, Medicare, Medicaid and the Children's Health Insurance Program (CHIP). The second phase, in October 2010, will present more detailed pricing and benefit information. Because the pricing and benefit information does not yet exist in an interoperable format, the IFR provides insurers and states with guidance and standards on the data to be collected.

As the web portal becomes populated with information for the October 1, 2010 release, interactive functions will be required to account for geographic information, gender and family composition for citizens exploring health insurance options. While the beginning phases of the web portal will be operated by HHS, there will be an open competition between July 1, 2010 and October 1, 2010 to contract a private vendor for implementation and maintenance of the PPACA web portal.

In time, the web portal will essentially become the main directory of the exchange, and many functions of the portal will transfer to the states in 2014. The new health care reform law is multifaceted and is going to require collaboration amongst the states, which predominately regulate and enforce the insurance industry, and the federal government to set standards and create architecture for interoperable data exchange.

While differences of opinion are likely to emerge, the states are encouraged to consider enterprise-wide solutions for the exchange of information and assess the budgetary and technological challenges that may exist for implementation. Remember, if a state declines to take the reins and create an exchange by 2014, Uncle Sam will step in to do its bidding. The State CIOs need to continue to track the new requirements set forth by the health care reform law and be prepared to provide solutions to the changing landscape of health information technology. State and Local Governments Advocate to Reallocate the 700 MHz D Block to Public Safety

On May 14, the Big Seven, which consists of the National Governors Association, National Conference of State Legislatures (NCSL), Council of State Governments (CSC), National Association of Counties (NACo), National League of Cities (NLC), U.S. Conference of Mayors and International City/County Management Association, held a House and Senate briefing discussing public safety needs for the 700 MHz D Block. The seven largest organizations representing state and local government as well as nearly a dozen public safety organizations are advocating before Congress to reallocate the D block to public safety instead of allowing the FCC to sell the spectrum as recommended in the National Broadband Plan.

FCC Affirms State Authority to Collect Information from Broadband Service Providers

The FCC this week ruled that states have authority to impose broadband data collection requirements on providers. The FCC’s ruling responded to a petition by the National Association of Regulatory Utility Commissioners seeking clarification whether FCC rules preempt states from requiring broadband service providers to file information on their infrastructure or services (Wireline Competition Docket No. 09-193). States have been relying on voluntary data submissions by providers on broadband access, use, and adoption information needed for state mapping projects. The FCC expressed no opinion as to whether individual states have authorized data collection by state commissions or other agencies, nor did it address the issue of whether a state or states should engage in broadband data collection to supplement federal efforts. FCC Grants Conditional Approval to Build Interoperable Broadband Networks

On May 12, The Federal Communications Commission (FCC) granted conditional waivers to 21 cities, counties and states that requested waivers to begin development of a nationwide interoperable network in the 10 MHz of broadband spectrum that has already been allocated to public safety. The FCC required that these broadband networks be deployed under a common framework in coordination with the FCC's new Emergency Response Interoperability Center (ERIC) to ensure interoperability.

FCC Begins Universal Service Reform Proceedings

In the May 13, Federal Register, the Federal Communications Commission (FCC) released a Notice of Inquiry (NOI) and a Notice of Proposed Rulemaking (NPRM) that address transitioning the federal Universal Service Fund (USF) from supporting voice services to broadband and making the fund more efficient. The NOI seeks comment on a cost model that would determine the minimum amount of USF funding to serve areas without broadband service and on the costs of using different broadband technologies to provide universal service. Comments on the proposed rules are due on July 12 and reply comments are due on August 11, 2010. NTIA Reopens Applications for Broadband Technology Opportunity Program (BTOP)

As a result of the FCC order granting waivers to 21 cities, counties and states to build interoperable broadband network, NTIA announced on May 13 that the agency is reopening the application filing window for Broadband Technology Opportunities Program Comprehensive Community Infrastructure projects. Entities that received waiver authority from the FCC are invited to file a BTOP application and request BTOP funding. All applications for funding CCI projects must be submitted between June 1, 2010 at 8:00 a.m. (EDT) and July 1 at 5:00 pm (EDT). The notice will be published in the May 19 Federal Register.

The Social Media Working Group and its legal sub-group are moving forward with provider terms of service discussions with YouTube. The group is drafting a social media best practice brief that is expected to be released June 2010.

The State Connectivity and Broadband Workgroup has completed comments on the Federal Communications Commission's National Broadband Plan, which were discussed during a session at the Midyear Conference. The Working Group is nearing the end of its chartered activity, but an extension of the charter is being developed, in light of continuing Federal and state broadband initiatives and related policy issues.
