Facebook Modifies Terms of Service for State and Local Government
After many discussions involving members of NASCIO's Social Media Legal Working Group and the National Association of Attorneys General (NAAG), Facebook has revised the standard terms of service to be provided to state and local governments through its "Pages" agreement. The revised terms resolve a series of legal issues identified by states in Facebook's standard terms of service and are available for immediate use.
Facebook has specifically agreed to modify the provisions of its terms and conditions to:
- Strike the indemnity clause except to the extent indemnity is allowed by a state's constitution or law;
- Strike language requiring that legal disputes be venued in California courts and adjudicated under California law;
- Require that a public agency include language directing consumers to its official Web site prominently on any Facebook page; and,
- Encourage amicable resolution between public entities and Facebook over any disputes.
The modifications will immediately apply to state and local government agencies already on Facebook.
NASCIO's Social Media Legal Workgroup and a NAAG task force began working with Facebook well over a year ago. Legal staff from the CIO's office and attorneys general agencies in the states of Colorado, Massachusetts, Michigan, New York, Pennsylvania, and Washington participated in the lengthy discussions. NASCIO expects the Facebook agreement will be used as a model going forward, as the legal workgroup continues efforts to produce similar models for other social media providers.

State IT Workforce: New Data Coming Soon
In the 2007 NASCIO survey, State IT Workforce: Here Today, Gone Tomorrow? A National Survey of the States, state CIOs offered anecdotal evidence that states could face a potential shortage of government IT workers in the near future due to anticipated retirements of baby boomers and a waning interest in government IT employment from the younger generation. Revisiting this looming issue, NASCIO plans to release updated results from a web-based survey that nearly every state CIO completed. Many CIOs will be looking at recruitment, retention and possible retirees for 2011. We expect to release the update to the survey on Tuesday, January 25.
Reflections of a Longtime Member
Otto Doll departed as the chief information officer for South Dakota's Bureau of Information and Telecommunications on January 7. He was with the state for more than 14 years and has been a longtime member of NASCIO, holding the second longest tenure as state CIO. Doll led or served on numerous NASCIO committees, including the Executive Committee, and was the recipient of the Meritorious Service Award in 2005. Many thanks Otto. You will greatly be missed at NASCIO!
Before his departure, NASCIO Connections interviewed Otto about his experiences:
What is your most memorable moment over the past years with the State of South Dakota? The moment I realized how much we affected the education of the children of South Dakota through technology and the impact of distance learning. Through videoconferencing facilities at every middle school and high school in the state or broadband access to the Internet for all schools, I feel every student and teacher has the tools to learn, to compete, with anyone else in the nation or the world.
What will you miss most about NASCIO? I will miss the interactions with my fellow CIOs. Whether through working together on committees, meeting at conferences or ad hoc telephone conversations, having the opportunity to seek advice and share experiences and lessons learned with other CIOs will truly be missed. We are addressing many of the same challenges and opportunities in our states. I have found my colleagues to be very willing to share and help in any way they can. I will miss the camaraderie of the state CIO community.
What do your future plans include? I hope to serve the public sector again in some capacity. (Also hope to get a few dart tournaments in along the way.)

The Collaborative Forum is Seeking Volunteers
NASCIO is still seeking CIO volunteers to participate in four working groups for the Collaborative Forum, an open and transparent venue for state and local officials as well as federal and non-governmental stakeholders. The working groups are shared services; auditing; eligibility, data aggregation, and analysis; and delivery/mechanisms. The Collaborative Forum is an opportunity to weigh in on potential pilot projects to be funded by the Office of Management and Budget's Partnership Fund for Program Integrity Innovation. The working groups will review submitted concepts and proposals that will be considered for funding by the Partnership Fund. The first rounds of funds are expected to be issued in March. Federal Communications Commission issues Notice of Inquiry on Framework for Next Generation 9-1-1 Deployment
On January 13, the Federal Communications Commission issued a Notice of Inquiry (NOI) initiating a comprehensive proceeding to address how Next Generation 9-1-1 (NG911) can enable the public to obtain emergency assistance by means of advanced communications technologies beyond traditional voice-centric devices. The NOI seeks to gain a better understanding of how the gap between the capabilities of modern networks, devices and today's 911 system can be bridged. The NOI also seeks comments on how to further the transition to IP-based communications capabilities for emergency communications and NG911. Federal Communications Commission issues Final Rule on Requests for Waiver of Various Petitioners to allow the establishment of 700 MHz Interoperable Public Safety Wireless Broadband Networks
On January 14, the Federal Communications Commission issued a final order recommending that the Emergency Response Interoperability Center (ERIC) of the Public Safety and Homeland Security Bureau approve an initial set of technical requirements for public safety jurisdictions (petitioners) that were granted conditional waivers for early deployment in the 700 MHz public safety broadband spectrum. The order grants petitioners that previously declined to file a renewed opportunity to do so and to proceed with network deployment. The order is effective as of December 10, 2010. Comments are due for the Department of Justice's Advance Notices of Proposed Rulemaking on State and Local Americans with Disabilities Compliance
January 24 is the comment deadline for three Department of Justice (DOJ) Advance Notices of Proposed Rulemaking (ANPRM). The ANPRMs concern extending Title II and III of the Americans with Disabilities Act (ADA) to state and local governments. NASCIO is planning to respond, so please forward your comments to Pam Walker at pwalker@AMRms.com.
DOJ is looking to revise the following items:
- The regulation implementing Title III of the ADA, in order to establish requirements for making the goods, services, facilities, privileges, accommodations, or advantages offered by public accommodations via the web accessible to individuals with disabilities. The agency is also considering revising the ADA's Title II regulation to establish requirements for making any services, programs or activities offered by state and local government to the public accessible via the web. - Requirements under Titles II and III of the ADA to ensure that equipment and furniture used in programs and services provided by public entities and public accommodation are accessible to individuals with disabilities. This ANPRM is seeking comments on whether state and local government are meeting the requirements by ensuring the accessibility of buildings, equipment and furniture by those with disabilities. - The regulation implementing Title II of the ADA to address in what manner public entities that operate 9-1-1 call-taking centers implement Next Generation 9-1-1. This ANPRM seeks information on possible revisions to the agency's regulation to ensure direct access to Next Generation 9-1-1 services for individuals with disabilities. Committee & Work Group Updates
The Corporate Leadership Council (CLC) is planning to gather for a face-to-face meeting in Washington, D.C., February 25 from 1:00 - 5:00 pm. SAVE THE DATE - the Enterprise Architecture and Governance Committee will present its next Innovations Forum on February 9. This government-only webinar will feature the state of Michigan strategy for protecting the government cloud, which addresses both traditional and emerging risks in a comprehensive and holistic manner.

The Health Care Working Group is formulating a whitepaper topic to provide guidance to the state CIOs on the Affordable Care Acts. The January 20 working group call included an update from Dave Roberts, vice president of government relations for the Health Information and Management System Society (HIMSS). Their public policy issues can be found at www.himss.org/advocacy/d/PolicyPrinciples2011.pdf. In addition to continued collaboration with strategic partners, a straw-man for the NASCIO whitepaper will be discussed in February.
The State Connectivity and Broadband Workgroup was re-chartered by the Executive Committee. The working group's goal will be to ensure that state CIOs are fully cognizant of the issues associated with continued growth of broadband networks across the nation, particularly as these are impacted by completion of Recovery Act projects and policies and/or programs that flow out of the National Broadband Plan. The working group will track broadband issues, promote best-practice efforts of individual state programs, and examine how leading edge states are leveraging broadband connectivity to spur economic growth and service delivery efforts.
The State Digital Identity Working Group has been providing feedback to the Smart Card Alliance (SCA) Identity and Physical Access Councils as they have developed a whitepaper on Personal Identity Verification Interoperability (PIV-I). The working group is planning further educational opportunities with the SCA and a webinar on identity management in state government. The PIV-I webinar is being targeted for March.
The State Digital Identity Working Group also continues development of the State Identity, Credentialing and Access Management (SICAM) document. The working group is looking at digital identity standards and an anticipated straw-man proposal will be distributed for comments. As for federal affairs, the National Strategy for Trusted Identities in Cyberspace (NSTIC) document is expected in the next few months, along with implementation guidance and grant opportunities. NASCIO will continue to harmonize with federal efforts and seek to develop active collaboration and pilots with federal agencies.

Doug Robinson, NASCIO executive director, will present a state CIO/state IT overview for the National Association of State Personnel Executives' orientation workshop January 28-29.
Robinson will be joined by Steve Fletcher, NASCIO past president and Utah CIO, and Adel Ebeid, New Jersey CIO, as panelists at the Governing Outlook in the States event February 1.
Chad Grant, NASCIO policy analyst, will represent the association at the Health Information and Management Systems Society's 2011 Annual Conference and Exhibition, February 20-24.
