State CIOs Identify 2012 Top Ten Priorities
Each year NASCIO conducts a survey of the state CIOs to identify and prioritize the top policy and technology issues facing state government in the year ahead. This year's survey found that consolidation, budget, governance, health care and cloud computing are among the most critical policy or technology issues to be faced by state government in 2012.
The top ten priorities help determine NASCIO's programs, conference sessions, and publications. The prioritized list can be downloaded at www.nascio.org/publications.
States Need a Core Services Taxonomy for IT Security Programs
"The Heart of the Matter: A Core Services Taxonomy for State IT Security Programs," NASCIO's newest issue brief, is available for download at www.nascio.org/publications. The brief identifies a taxonomy of core, critical IT security services to facilitate the analysis of requirements, sourcing options, and costs for delivering appropriate security.
NASCIO Annual Conference a Huge Success
Representatives from 50 states and territories and more than 100 partner organizations gathered October 2-5 for the NASCIO Annual Conference in Denver. According to evaluation results, 100 percent of respondents stated the conference met or exceeded their expectations. "I congratulate NASCIO on an excellent conference," said Dugan Petty, NASCIO president and Oregon CIO. "With record attendance of 600 attendees, exceptional involvement from states and partners, and highly-rated sessions, the 2011 Annual Conference was an event not to be missed."

Stephen Fletcher, Utah CIO, Honored with Meritorious Service Award
NASCIO presented Utah CIO Stephen Fletcher with its prestigious Meritorious Service Award during the 2011 Annual Conference. Utah Gov. Gary R. Herbert said, "The State of Utah is grateful for the exceptional service Stephen Fletcher has rendered our agencies and our citizens. In a time of monumental transition and the redefinition of enterprise level IT services, he has demonstrated visionary leadership, a steady hand, and an unflagging commitment to principles of good governance and sound fiscal management." NASCIO Elects New Officers and Directors
NASCIO members recently elected Oregon CIO Dugan Petty to lead the organization as NASCIO 2011-2012 president. Petty succeeds West Virginia Chief Technology Officer Kyle Schafer.

NASCIO Recognizes Ruth Johnson for Exceptional Contributions in State Government
NASCIO recently honored Ruth Johnson, secretary of the Louisiana Department of Children and Family Services, with the 2011 State Technology Innovator award. Johnson was chosen for her efforts to leverage technology in state government to keep children safe, help individuals and families become self-sufficient, and provide safe refuge during disasters. New Continuing Resolution Could Be Added to Minibus Bill
Congress is expected to clear a few minibus spending bills in place of omnibus bills. Progress was made earlier this month on the first of several smaller FY12 appropriation packages including the Agriculture, Commerce-Justice-Science and Transportation-Housing and Urban Development appropriations bills. Approximately a month before the government runs out of spending authority, lawmakers will have to attach a new continuing resolution on the minibus bill to keep the government running into late December. The current resolution expires November 18.
FCC to Vote on USF Overhaul
The FCC's October 27 meeting will include a vote on Chairman Julius Genachowski's plan to overhaul the high-cost portion of the Universal Service Fund. The program was originally designed to decrease landline phone access, but Genachowski wants to transition the fund to pay for expanding high-speed Internet access. NASCIO and NASTD submitted joint comments regarding the modernizing and streamlining of universal service. The FCC will also vote on reforming intercarrier compensation rules that determine how much companies pay to carry each other's traffic. You can watch the meeting live on the

ECPA Update Expected by End of Year
On October 20, Senate Judiciary Chairman Patrick Leahy (D-Vt.) announced he plans to schedule a markup before the end of the year to update the Electronic Communications Privacy Act (ECPA). In May, Senator Leahy introduced legislation (S.1011) to update the 25-year-old law, which deals with law enforcement access to electronic communications. S. 1011 would require the government to obtain a warrant before accessing an individual's email, digital communications or geo-location information. Many believe that current law has failed to keep up with changes in technology and the missions of law enforcement agencies.
Technology companies, privacy advocates and other supporters formed the Digital Due Process Coalition to push for updating ECPA. They argue that the law is out of date and provides different legal standards for different types of electronic communications, such as email and stored electronic data. They also argue that the law's differing legal protections are hampering the growth of some new technologies, such as cloud computing. S. 1011 chances for enactment are unclear. In a statement just prior to the 25th anniversary of ECPA's enactment, Leahy said, "When I led the effort to write the ECPA 25 years ago, no one could have contemplated the many emerging threats to our digital privacy."

NASCIO and the Enterprise Architecture and Governance Committee have released the second in a series on cloud computing, "Capitals in the Clouds: Challenges and Opportunities to Get Your Data Right." Available at www.nascio.org/publications, the brief emphasizes that data management is a critical element for any enterprise approach to sharing IT resources, including cloud computing.

The Social Media Forum Legal Subgroup's discussions with legal representatives from YouTube are now focused on the process by which Google and YouTube will make new terms available. It is hoped that outstanding issues can be resolved in the next few weeks.
The Department of Homeland Security's National Cyber Security Review (NCSR) survey is currently underway, and many states have begun the process of completing the survey, which closes November 15. The NCSR represents the first national survey of state and municipal government cyber readiness, and the survey has been promoted from its inception by NASCIO and the Multi-State Information Sharing and Analysis Center (MS-ISAC). NASCIO: Making Connections
Steve Fletcher, Utah chief information officer; Doug Robinson, NASCIO executive director; and Eric Sweden, NASCIO program director, enterprise architecture and governance; attended the Global Justice Advisory Committee Meeting, October 12- 13 in Washington, D.C.
Robinson was a speaker at the Gartner Symposium October 17-18 in Orlando.
Sweden represented NASCIO at the U.S. Department of Justice, Bureau of Justice Assistance, Training and Technical Assistance Committee meeting i October 19-20. Sweden led a discussion on best practices and consistency in service delivery from the various service providers.
Chad Grant, NASCIO senior policy analyst, will participate on a panel at the 10th Annual Smart Card Alliance Government Conference in Washington, D.C., November 3.
