Statement from NASCIO Opposing Executive Action to Block State AI Regulations

The National Association of State Chief Information Officers (NASCIO) strongly opposes any executive order that would strip states of their authority to enforce AI laws and regulations. States have developed thoughtful, stakeholder-driven AI policies tailored to their citizens’ needs — halting or preempting these efforts would undermine democratic governance and public trust. NASCIO and other state and local associations shared our concerns about the inclusion of a similar moratorium in the One Big Beautiful Bill Act, and Congress agreed.

We urge the Administration to instead work collaboratively with states, respecting their role as “laboratories of democracy.” We must build a federal baseline that supports innovation without eroding state-level protections. NASCIO remains committed to ensuring responsible AI development, and we affirm that preemption or moratoria on state AI enforcement are deeply misaligned with both the interests of state governments and the needs of residents.
